Publisher Terms and Conditions

These terms and conditions are made between:

  1. Lead Intelligence Ltd a company registered in England & Wales with company number 125466685 and whose registered office is at 71-75 Shelton Street, London, Greater London, United Kingdom, WC2H 9JQ and

  2. "The Partner” also known as the affiliate or publisher

 

Scope of Work:

  • The Partner wishes to supply traffic to the Lead Intelligence landing pages in order to generate leads and /or supply leads via The Partner pre-approved landing page(s) to be used by Lead Intelligence specifically for processing and analysis purposes and by the End Client for the purposes of sales and marketing.

  • Lead Intelligence wishes to accept the traffic and subsequent leads from the Partner, subject to the terms and conditions contained herein.

Terms of Service:

  • Traffic

    • The Partner must only deliver traffic via the pre-approved marketing channel(s) (i.e., email, social, native, PPC, display etc.)

    • Traffic must not be driven at weekends (Saturday & Sunday) unless previously approved by Lead Intelligence

    • Traffic must not be driven outside of the specified hours unless previously approved by Lead Intelligence

  • Lead Transfer

    • The Partner must post the leads in real time via the Lead Intelligence API system

    • The Partner must post a test lead using the test string provided in the API briefing documentation prior to commencing lead delivery

    • The Partner must receive written confirmation (via email) from Lead Intelligence that the API is set up and functioning correctly before commencing lead delivery

    • Once approved the Partner must commence lead delivery via the live post string (as detailed in the API briefing document)

 

Tracking (Traffic Only)

  • Lead Intelligence will provide the Partner with a unique tracking link (per campaign). The link will include up to 3 additional variables to allow the Partner to pass additional tracking information required to accurately measure the campaign

  • The Partner will provide Lead Intelligence with a Post Back URL to be used to track valid conversions

  • The Partner will only commence traffic once both Lead Intelligence and the Partner have successfully tested the post back tracking

  • Where necessary Lead Intelligence will place pixels directly on the landing page in order to track click and audiences. However, conversion should be tracked using post back URL’s (server to server tracking) only.

 

Creative Approval Process

  • The Partner must upload all creative assets to the Campaign Creative Hub portal and receive approval from Lead Intelligence for:

    • The Ads (including; images, headlines, descriptions, html emails & banner ads) used to promote the landing page(s)

  • Only once approved  the Partner can commence traffic

  • Should the Partner make creative changes to the Ads. The Partner should (unless agreed otherwise prior to commencement):

    • Pause the traffic

    • Request approval from Lead Intelligence (via Campaign Creative Hub)

    • Resume the traffic once Lead Intelligence have approved the changes

    • If non compliance of the process is found in the live environment Lead Intelligence Ltd will have no option but to terminate the relationship with forfeiture of all fees owed as an indemnity against compliance risks brought about by non compliance.

 

Validation & Returns

  • Real time validation rejections include (the post back URL will not be triggered if validation fails):

    • Invalid telephone number

    • Duplicate lead

    • Failed campaign criteria

    • Supplied out of hours

    • Cap reached

  • Where there are post lead delivery client returns, Lead Intelligence will process the returns and return to the Partner on a monthly basis no later than the 5th working day of the following month. Client returns include:

    • Invalid telephone number

    • Wrong number / Hoax lead

    • Failed Client Criteria

    • Client duplicate

    • Fraudulent traffic

 

Payment Terms

  • Unless otherwise agreed the Lead Intelligence standard payment terms will be applied.

  • Standard payment terms:

    • Net 30 days from the end of the month

 

Regulatory Requirements

Lead Intelligence requires its Partner’s to comply with relevant industry regulation, such as, but not limited to:

  • The UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

  • The Office of Communications Regulation (Ofcom). If applicable.

  • The Privacy and Electronic Communications (EC Directive) Regulations 2003.

  • Advertising Standards Agency Guidance (ASA)

If non compliance of the regulatory requirements is found in the live environment Lead Intelligence Ltd will have no option but to terminate the relationship with forfeiture of all fees owed as an indemnity against compliance risks brought about by non compliance of the regulatory requirements.
